By using the services of Everly & Loft (“we,” “us,” “our”), you agree to the terms outlined below. These terms are designed to clarify our responsibilities and your rights as a customer of custom bookbinding and restoration services.

1. Services

Everly & Loft offers custom decorative rebinding services. We do not print, copy, or reproduce copyrighted material. All work is done on existing, lawfully owned books or materials provided by the customer or purchased from an established and reputable bookseller.

2. Copyright & Intellectual Property

We fully respect the rights of publishers, authors, and copyright holders.

  • You must provide us with physical books or content that you legally own.

  • We do not replicate, duplicate, or digitize copyrighted material.

  • Our services fall under the First Sale Doctrine (17 U.S.C. § 109), which allows the owner of a lawfully acquired book to alter, sell, or transfer that specific copy. Our modifications are limited to the physical book you own and do not involve unauthorized copying or redistribution.

  • All original intellectual property created by Everly & Loft, including designs, graphics, or branding elements, remain our property and may not be reproduced without permission.

3. Customer Responsibilities

By submitting a book for rebinding or restoration, you affirm that:

  • You are the legal owner of the material.

  • You understand that the work performed is cosmetic or structural repair, not reproduction.

  • You agree not to ask us to create or bind pirated or infringing materials.

4. Limitations of Liability

While we take the utmost care in handling and working on your books, we are not responsible for:

  • Pre-existing damage to books or materials.

  • Wear resulting from normal use of handmade or restored items.

  • Minor cosmetic imperfections due to the handcrafted nature of our work.

We do not guarantee preservation outcomes for fragile or antique books.

6. Shipping & Risk of Loss

Customers are responsible for shipping books to us and assume the risk of loss during transit. We recommend using trackable and insured shipping methods. We are not responsible for damage or loss caused by shipping carriers.

7. Changes to Terms

We may update these Terms at any time. The latest version will always be posted on our website and becomes effective immediately upon posting.

8. Governing Law

These Terms are governed by the laws of the United States. Any disputes will be handled under the jurisdiction of applicable U.S. courts.

9 . Products

We make every effort to display as accurately as possible the colors, features, specifications, and details of the products available on the Services. However, we do not guarantee that the colors, features, specifications, and details of the products will be accurate, complete, reliable, current, or free of other errors, and your electronic display may not accurately reflect the actual colors and details of the products. All products are subject to availability, and we cannot guarantee that items will be in stock. We reserve the right to discontinue any products at any time for any reason. Prices for all products are subject to change.

11 . Privacy Policy

Everly & Loft reserves the right to decline or cancel any order at our discretion. We may limit the quantity of items purchased per customer, household, payment method, or shipping address. We also reserve the right to reject orders we believe are intended for resale or distribution by dealers or bulk buyers.

We take your privacy and data security seriously. By using our services, you agree to our Privacy Policy, which is part of these Terms. Our services are hosted in the United States. If you access them from outside the U.S., you consent to your data being transferred to and processed in the U.S. in accordance with our policy.

Our services are provided “as is” and we can’t guarantee they’ll always work perfectly or be free of errors. You use them at your own risk. We don’t make promises about the accuracy, reliability, or safety of the content or any links. We’re not responsible for any damage, data loss, viruses, or issues from third-party products or services. Always use good judgment when using the internet or making purchases.

13. Limitations of Liablity

We’re not responsible for any damages—direct or indirect—that result from your use of our services, even if we were warned it could happen. This includes things like lost profits, lost data, or other losses. If we are found liable for any reason, the most we’d owe you is either what you paid us in the last six months or $250—whichever is less. Some laws may give you additional rights or limit how much these rules apply to you.

14. Artistic Images & Mockups

Due to the custom and artistic nature of the products offered, Everly & Loft reserves the right to reject any design request by anyone at any time and/or any potential projects that involve subject matter that we do not approve of. Books sent to us and not paid for will be discarded after six months. All images and mockups on this website are for visualization purposes only and may not reflect real life products. When products are viewed in different lighting conditions or at different angles, the product may have a different appearance than the mockups and marketing photos that appear online. We are not responsible if they do not match exactly what you expected.

15. Artistic Expression

You acknowledge that our services involve significant modifications to the physical condition of your book, including but not limited to the removal of the cover and pages. These modifications are performed as part of an artistic process, and the final product is a unique artistic expression. Books are made in a wide range of sizes and dimensions and our designers must format the design appropriately. The final result may vary and may not represent what is depicted in online mockups on this website. We are not liable for any dissatisfaction you may experience as a result of the artistic modifications. By agreeing to these terms, you waive any claims against our company for the condition or appearance of the modified book.
